Contractors are subject to the provisions of the Jessica Lunsford Act (F.S.1012.465) – Background screening requirements for certain non instructional school district employees and contractors. Non instructional school district employees or contractual personnel who are permitted access on school grounds when students are present, who have direct contact with students or who have access to or control of school funds must meet level 2 screening requirements as described in s. 1012.32. Contractual personnel shall include any vendor, individual, or entity under contract with a school or the school board.

Miscellaneous

Section 29 – Rights of electricity consumers regarding solar energy choice. –

(a) ESTABLISHMENT OF CONSTITUTIONAL RIGHT. Electricity consumers have the right to own or lease solar equipment installed on their property to generate electricity for their own use.

(b) RETENTION OF STATE AND LOCAL GOVERNMENTAL ABILITIES. State and local governments shall retain their abilities to protect consumer rights and public health, safety and welfare, and to ensure that consumers who do not choose to install solar are not required to subsidize the costs of backup power and electric grid access to those who do.

(c) DEFINITIONS. For purposes of this section, the following words and terms shall have the following meanings:

(1) “consumer” means any end user of electricity regardless of the source of that electricity.

(2) “solar equipment,” “solar electrical generating equipment” and “solar” are used interchangeably and mean photovoltaic panels and any other device or system that converts sunlight into electricity.

(3) “backup power” means electricity from an electric utility, made available to solar electricity consumers for their use when their solar electricity generation is insufficient or unavailable, such as at night, during periods of low solar electricity generation or when their solar equipment otherwise is not functioning.

(4) “lease,” when used in the context of a consumer paying the owner of solar electrical generating equipment for the right to use such equipment, means an agreement under which the consumer pays the equipment owner/lessor a stream of periodic payments for the use of such equipment, which payments do not vary in amount based on the amount of electricity produced by the equipment and used by the consumer/lessee.

(5) “electric grid” means the interconnected electrical network, consisting of power plants and other generating facilities, transformers,

transmission lines, distribution lines and related facilities, that makes electricity available to consumers throughout Florida.

(6) “electric utility” means any municipal electric utility, investor-owned electric utility, or rural electric cooperative which owns, maintains,

or operates an electric generation, transmission, or distribution system within the state.

(d) EFFECTIVE DATE. This section shall be effective immediately upon voter approval of this amendment.

Ballot Title:

Use of Marijuana for Debilitating Medical Conditions

Ballot Summary:

Allows medical use of marijuana for individuals with debilitating medical conditions as determined by a licensed Florida physician. Allows caregivers to assist patients’ medical use of marijuana. The Department of Health shall register and regulate centers that produce and distribute marijuana for medical purposes and shall issue identification cards to patients and caregivers. Applies only to Florida law. Does not immunize violations of federal law or any non-medical use, possession or production of marijuana.

Financial Impact Statement:

Increased costs from this amendment to state and local governments cannot be determined. There will be additional regulatory costs and enforcement activities associated with the production, sale, use and possession of medical marijuana. Fees may offset some of the regulatory costs. Sales tax will likely apply to most purchases, resulting in a substantial increase in state and local government revenues that cannot be determined precisely. The impact on property tax revenues cannot be determined.

ARTICLE X

Miscellaneous

SECTION 29.–   Medical marijuana production, possession and use.

(a) PUBLIC POLICY.

(1) The medical use of marijuana by a qualifying patient or caregiver in compliance with this section is not subject to criminal or civil liability or sanctions under Florida law.

(2) A physician shall not be subject to criminal or civil liability or sanctions under Florida law solely for issuing a physician certification with reasonable care to a person diagnosed with a debilitating medical condition in compliance with this section.

(3) Actions and conduct by a Medical Marijuana Treatment Center registered with the Department, or its agents or employees, and in compliance with this section and Department regulations, shall not be subject to criminal or civil liability or sanctions under Florida law.

(b) DEFINITIONS.   For purposes of this section, the following words and terms shall have the following meanings:

(1) “Debilitating Medical Condition” means cancer, epilepsy, glaucoma, positive status for human immunodeficiency virus (HIV), acquired immune deficiency syndrome (AIDS), post-traumatic stress disorder (PTSD), amyotrophic lateral sclerosis (ALS), Crohn’s disease, Parkinson’s disease, multiple sclerosis, or other debilitating medical conditions of the same kind or class as or comparable to those enumerated, and for which a physician believes that the medical use of marijuana would likely outweigh the potential health risks for a patient.

(2) “Department” means the Department of Health or its successor agency.

(3) “Identification card” means a document issued by the Department that identifies a qualifying patient or a caregiver.

(4)  “Marijuana” has the meaning given cannabis in Section 893.02(3), Florida Statutes (2014), and, in addition, “Low-THC cannabis” as defined in Section 381.986(1)(b), Florida Statutes (2014), shall also be included in the meaning of the term “marijuana.”

(5)  “Medical Marijuana Treatment Center” (MMTC) means an entity that acquires, cultivates, possesses, processes (including development of related products such as food, tinctures, aerosols, oils, or ointments), transfers, transports, sells, distributes, dispenses, or administers marijuana, products containing marijuana, related supplies, or educational materials to qualifying patients or their caregivers and is registered by the Department.

(6) “Medical use” means the acquisition, possession, use, delivery, transfer, or administration of an amount of marijuana not in conflict with Department rules, or of related supplies by a qualifying patient or caregiver for use by the caregiver’s designated qualifying patient for the treatment of a debilitating medical condition.

(7) “Caregiver” means a person who is at least twenty-one (21) years old who has agreed to assist with a qualifying patient’s medical use of marijuana and has qualified for and obtained a caregiver identification card issued by the Department. The Department may limit the number of qualifying patients a caregiver may assist at one time and the number of caregivers that a qualifying patient may have at one time. Caregivers are prohibited from consuming marijuana obtained for medical use by the qualifying patient.

(8) “Physician” means a person who is licensed to practice medicine in Florida.

(9)“Physician certification” means a written document signed by a physician, stating that in the physician’s professional opinion, the patient suffers from a debilitating medical condition, that the medical use of marijuana would likely outweigh the potential health risks for the patient, and for how long the physician recommends the medical use of marijuana for the patient. A physician certification may only be provided after the physician has conducted a physical examination and a full assessment of the medical history of the patient. In order for a physician certification to be issued to a minor, a parent or legal guardian of the minor must consent in writing.

(10) “Qualifying patient” means a person who has been diagnosed to have a debilitating medical condition, who has a physician certification and a valid qualifying patient identification card. If the Department does not begin issuing identification cards within nine (9) months after the effective date of this section, then a valid physician certification will serve as a patient identification card in order to allow a person to become a “qualifying patient” until the Department begins issuing identification cards.

(c) LIMITATIONS.

(1) Nothing in this section allows for a violation of any law other than for conduct in compliance with the provisions of this section.

(2) Nothing in this section shall affect or repeal laws relating to non-medical use, possession, production, or sale of marijuana.

(3) Nothing in this section authorizes the use of medical marijuana by anyone other than a qualifying patient.

(4) Nothing in this section shall permit the operation of any vehicle, aircraft, train or boat while under the influence of marijuana.

(5) Nothing in this section requires the violation of federal law or purports to give immunity under federal law.

(6) Nothing in this section shall require any accommodation of any on-site medical use of marijuana in any correctional institution or detention facility or place of education or employment, or of smoking medical marijuana in any public place.

(7) Nothing in this section shall require any health insurance provider or any government agency or authority to reimburse any person for expenses related to the medical use of marijuana.

(8) Nothing in this section shall affect or repeal laws relating to negligence or professional malpractice on the part of a qualified patient, caregiver, physician, MMTC, or its agents or employees.

(d) DUTIES OF THE DEPARTMENT.   The Department shall issue reasonable regulations necessary for the implementation and enforcement of this section. The purpose of the regulations is to ensure the availability and safe use of medical marijuana by qualifying patients. It is the duty of the Department to promulgate regulations in a timely fashion.

(1) Implementing Regulations. In order to allow the Department sufficient time after passage of this section, the following regulations shall be promulgated no later than six (6) months after the effective date of this section:

a. Procedures for the issuance and annual renewal of qualifying patient identification cards to people with physician certifications and standards for renewal of such identification cards. Before issuing an identification card to a minor, the Department must receive written consent from the minor’s parent or legal guardian, in addition to the physician certification.

b. Procedures establishing qualifications and standards for caregivers, including conducting appropriate background checks, and procedures for the issuance and annual renewal of caregiver identification cards.

c. Procedures for the registration of MMTCs that include procedures for the issuance, renewal, suspension and revocation of registration, and standards to ensure proper security, record keeping, testing, labeling, inspection, and safety.

d. A regulation that defines the amount of marijuana that could reasonably be presumed to be an adequate supply for qualifying patients’ medical use, based on the best available evidence. This presumption as to quantity may be overcome with evidence of a particular qualifying patient’s appropriate medical use.

(2) Identification cards and registrations. The Department shall begin issuing qualifying patient and caregiver identification cards, and registering MMTCs no later than nine (9) months after the effective date of this section.

(3) If the Department does not issue regulations, or if the Department does not begin issuing identification cards and registering MMTCs within the time limits set in this section, any Florida citizen shall have standing to seek judicial relief to compel compliance with the Department’s constitutional duties.

(4) The Department shall protect the confidentiality of all qualifying patients. All records containing the identity of qualifying patients shall be confidential and kept from public disclosure other than for valid medical or law enforcement purposes.

(e) LEGISLATION.   Nothing in this section shall limit the legislature from enacting laws consistent with this section.

(f) SEVERABILITY.   The provisions of this section are severable and if any clause, sentence, paragraph or section of this measure, or an application thereof, is adjudged invalid by a court of competent jurisdiction other provisions shall continue to be in effect to the fullest extent possible.

ARTICLE VII

FINANCE AND TAXATION

SECTION 6.  Homestead exemptions.—

(a)  Every person who has the legal or equitable title to real estate and maintains thereon the permanent residence of the owner, or another legally or naturally dependent upon the owner, shall be exempt from taxation thereon, except assessments for special benefits, up to the assessed valuation of twenty-five thousand dollars and, for all levies other than school district levies, on the assessed valuation greater than fifty thousand dollars and up to seventy-five thousand dollars, upon establishment of right thereto in the manner prescribed by law. The real estate may be held by legal or equitable title, by the entireties, jointly, in common, as a condominium, or indirectly by stock ownership or membership representing the owner’s or member’s proprietary interest in a corporation owning a fee or a leasehold initially in excess of ninety-eight years. The exemption shall not apply with respect to any assessment roll until such roll is first determined to be in compliance with the provisions of section 4 by a state agency designated by general law. This exemption is repealed on the effective date of any amendment to this Article which provides for the assessment of homestead property at less than just value.

(b)  Not more than one exemption shall be allowed any individual or family unit or with respect to any residential unit. No exemption shall exceed the value of the real estate assessable to the owner or, in case of ownership through stock or membership in a corporation, the value of the proportion which the interest in the corporation bears to the assessed value of the property.

(c)  By general law and subject to conditions specified therein, the Legislature may provide to renters, who are permanent residents, ad valorem tax relief on all ad valorem tax levies. Such ad valorem tax relief shall be in the form and amount established by general law.

(d)  The legislature may, by general law, allow counties or municipalities, for the purpose of their respective tax levies and subject to the provisions of general law, to grant either or both of the following additional homestead tax exemptions:

(1)  An exemption not exceeding fifty thousand dollars to any person who has the legal or equitable title to real estate and maintains thereon the permanent residence of the owner and who has attained age sixty-five and whose household income, as defined by general law, does not exceed twenty thousand dollars; or

(2)  An exemption equal to the assessed value of the property to any person who has the legal or equitable title to real estate with a just value less than two hundred and fifty thousand dollars and who has maintained thereon the permanent residence of the owner for not less than twenty-five years and who has attained age sixty-five and whose household income does not exceed the income limitation prescribed in paragraph (1).

The general law must allow counties and municipalities to grant these additional exemptions, within the limits prescribed in this subsection, by ordinance adopted in the manner prescribed by general law, and must provide for the periodic adjustment of the income limitation prescribed in this subsection for changes in the cost of living.

(e)  Each veteran who is age 65 or older who is partially or totally permanently disabled shall receive a discount from the amount of the ad valorem tax otherwise owed on homestead property the veteran owns and resides in if the disability was combat related and the veteran was honorably discharged upon separation from military service. The discount shall be in a percentage equal to the percentage of the veteran’s permanent, service-connected disability as determined by the United States Department of Veterans Affairs. To qualify for the discount granted by this subsection, an applicant must submit to the county property appraiser, by March 1, an official letter from the United States Department of Veterans Affairs stating the percentage of the veteran’s service-connected disability and such evidence that reasonably identifies the disability as combat related and a copy of the veteran’s honorable discharge. If the property appraiser denies the request for a discount, the appraiser must notify the applicant in writing of the reasons for the denial, and the veteran may reapply. The Legislature may, by general law, waive the annual application requirement in subsequent years. This subsection is self-executing and does not require implementing legislation.

(f)  By general law and subject to conditions and limitations specified therein, the Legislature may provide ad valorem tax relief equal to the total amount or a portion of the ad valorem tax otherwise owed on homestead property to the:

(1)  The surviving spouse of a veteran who died from service-connected causes while on active duty as a member of the United States Armed Forces.

(2)  The surviving spouse of a first responder who died in the line of duty.

(3)  A first responder who is totally and permanently disabled as a result of an injury or injuries sustained in the line of duty. Causal connection between a disability and service in the line of duty shall not be presumed but must be determined as provided by general law. For purposes of this paragraph, the term “disability” does not include a chronic condition or chronic disease, unless the injury sustained in the line of duty was the sole cause of the chronic condition or chronic disease.

As used in this subsection and as further defined by general law, the term:

a.  “first responder” means a law enforcement officer, a correctional officer, a firefighter, an emergency medical technician, or a paramedic, and the term.

b.  “in the line of duty” means arising out of and in the actual performance of duty required by employment as a first responder.

SCHEDULE

Tax exemption for totally and permanently disabled first responders.—The amendment to Section 6 of Article VII relating to relief from ad valorem taxes assessed on homestead property for first responders, who are totally and permanently disabled as a result of injuries sustained in the line of duty, takes effect January 1, 2017.

Sección 29 – Derechos de los consumidores de electricidad respecto a la elección de la Energía Solar. –

(a) ESTABLECIMIENTO DEL DERECHO CONSTITUCIONAL. Los consumidores de electricidad tienen el derecho de poseer o arrendar un equipo solar instalado en su propiedad para la generación de su propia electricidad.

(b) SOBRE LAS POTESTADES DEL GOBIERNO ESTATAL Y DEL GOBIERNO LOCAL. El gobierno estatal y el gobierno local mantienen la potestad de proteger los derechos de los consumidores y la salud pública, la seguridad y el bienestar, y garantizan que los consumidores que no deseen la instalación solar no deban subsidiar los costos de la electricidad de reserva ni el acceso a la red de suministro eléctrico de quienes sí lo hacen.

(c) DEFINICIONES. Para los propósitos de esta sección, las siguientes palabras y términos deben ser entendidos de la siguiente manera:

(1) “consumidor” es cualquier usuario final de electricidad independientemente de la fuente de esa energía.

(2) “equipo solar,” “equipamiento generador de energía solar”, “instalación solar” se utilizan indistintamente y se refieren a los paneles fotovoltaicos y a cualquier otro dispositivo o sistema que transforme la energía solar en electricidad.

(3) “energía de reserva” es la electricidad generada por una compañía de electricidad y utilizada por los consumidores de electricidad solar cuando ésta es insuficiente o no está disponible, como en la noche, en los períodos de baja generación de electricidad solar o cuando su equipo no funciona.

(4) “arrendamiento”, cuando el término es usado en el contexto del pago por el derecho de uso de un consumidor al dueño de un equipamiento generador de energía solar, es un acuerdo en el que el consumidor le abona al dueño/arrendador una serie de pagos periódicos para el uso del equipo, cuyo monto no varía en relación a la cantidad de electricidad producida por el equipamiento ni la utilizada por el consumidor/arrendatario.

(5) “red de suministro eléctrico” es la red eléctrica interconectada; consiste en las plantas de energía y otras instalaciones de generación y transformación, líneas transmisoras y de distribución, y todas las instalaciones que hacen que la electricidad esté disponible para todos los consumidores en Florida.

(6) “compañía de electricidad” significa cualquier compañía eléctrica municipal, propiedad de los inversores o cooperativa eléctrica rural que posea, mantenga u opere un sistema eléctrico de generación, transmisión o distribución dentro del estado.

(d) ENTRADA EN VIGENCIA. Esta sección será efectiva inmediatamente después de la aprobación de esta enmienda mediante el voto.

Permite la utilización médica de la marihuana para aquellos individuos con condiciones médicas degenerativas diagnosticadas por un médico licenciado en Florida. Permite a los cuidadores asistir a los pacientes en el uso médico de la marihuana. El Departamento de Salud debe certificar y regular los centros que producen y distribuyen la marihuana y debe expedir documentos de identificación para los pacientes y cuidadores. Se aplica únicamente para la ley de Florida. No invalida las violaciones de la ley federal o cualquier uso no medicinal, posesión o producción de marihuana.

Declaración sobre impacto financiero:

No puede determinarse el aumento de los costos para el gobierno estatal y el gobierno local debido a esta enmienda. Habrá costos adicionales de regulación y por las actividades de implementación asociadas con la producción, venta, uso y posesión de la marihuana medicinal. Los aranceles podrían compensar algunos de los costos regulatorios. Los impuestos sobre las ventas probablemente se apliquen a la mayoría de las compras, lo que daría como resultado un aumento sustancial pero difícil de precisar de los ingresos del gobierno estatal y local. Misceláneas

SECCIÓN 29.–   Producción, posesión y uso de la marihuana medicinal.

(a) POLÍTICA PÚBLICA.

(1) El uso medicinal de la marihuana por parte de un paciente calificado o un cuidador, en el cumplimiento de esta sección, no está sujeto a la responsabilidad criminal ni civil o a sanción alguna bajo la ley de Florida.

(2) El médico que expida un certificado para el cuidado razonable de una persona diagnosticada con una condición médica degenerativa, no tendrá responsabilidad civil o criminal o sanción alguna bajo la ley de Florida sólo por la ello, de acuerdo a esta sección.

(3) Las acciones y conductas de un Centro de Tratamiento Médico con Marihuana certificado por el Departamento, o sus agentes o empleados, y de acuerdo con esta sección y las regulaciones del Departamento, no estarán sujetas a la responsabilidad civil ni criminal, o a sanción alguna bajo la ley de Florida.

(b) DEFINICIONES. Para los propósitos de esta sección, las siguientes palabras y términos deben tener los siguientes significados:

(1)  “Condición médica degenerativa” significa cáncer, epilepsia, glaucoma, ser positivo en el virus de la inmunodeficiencia humana (VIH), síndrome de inmunodeficiencia adquirida (SIDA), trastorno de estrés post-traumático (TEPT), esclerosis lateral amiotrófica (ELA), enfermedad de Crohn, Parkinson, múltiples esclerosis u otras condiciones médicas degenerativas del mismo tipo o clase o comparables con las enumeradas, y para las que un médico considere que el uso de la marihuana medicinal pueda contrarrestar los riesgos potenciales en la salud del paciente.

(2) “Departamento” refiere al Departamento de Salud o a su agencia representante.

(3) “Documento de identificación” es una credencial expedida por el Departamento que identifica a los pacientes calificados o a los cuidadores.

(4)  “Marihuana” tiene el significado dado al cannabis en la Sección 893.02(3), Estatuto de Florida (2014), y, además, también se debe incluir “cannabis con bajo THC” como es definido en la Sección 381.986(1)(b), Estatuto de Florida (2014).

(5)  “Centro de Tratamiento Médico con Marihuana” (CTMM) es una institución que adquiere, cultiva, posee, procesa (incluido el desarrollo de productos relacionados, como comida, tinturas, aerosoles, aceites o pomadas), transfiere, transporta, vende, distribuye, reparte o administra marihuana, productos que tienen marihuana, suministros relacionados o material educacional, a pacientes calificados o a sus cuidadores, y que está certificado por el Departamento.

(6) “Uso médico” significa la adquisición, posesión, uso, entrega, transferencia o administración de una cantidad de marihuana, que no esté en conflicto con las reglas del Departamento, o de los suministros relacionados, por un paciente calificado o cuidador para el uso del paciente calificado para el tratamiento de su condición médica degenerativa.

(7) “Cuidador” es una persona que tiene, por los menos, veintiún (21) años de edad, que ha acordado ayudar con la utilización de la marihuana medicinal en los pacientes calificados y que se ha capacitado y ha obtenido un documento de identificación certificado por el Departamento. El Departamento puede limitar la cantidad de pacientes calificados que un cuidador puede asistir al mismo tiempo, así como también el número de cuidadores que puede tener un paciente calificado. Está terminantemente prohibido el consumo de marihuana obtenida para el uso medicinal de los pacientes calificados por parte de los cuidadores.

(8)  “Médico” es la persona matriculada para practicar la medicina en Florida.

(9) “Certificado médico” es un documento escrito, firmado por un médico que indica que, de acuerdo a la opinión profesional del médico, el paciente sufre de una condición médica degenerativa y que el uso medicinal de la marihuana podría ayudar a contrarrestar los potenciales riesgos para su salud, por lo que el médico recomienda su utilización. El certificado médico sólo puede ser provisto luego de que el médico haya realizado un examen físico y una evaluación completa de la historia clínica del paciente. Para que Un médico pueda emitir un certificado a nombre de un menor, su padre o responsable legal debe consentirlo por escrito.

(10) “Paciente calificado” es una persona que ha sido diagnosticada con una condición médica degenerativa, que posee un certificado médico y un documento válido que lo identifica como paciente calificado. Si el Departamento no comienza la emisión de los documentos de identificación luego de nueve (9) meses de la fecha efectiva de esta sección, entonces servirá como documento de identificación del paciente el certificado médico válido con el objetivo de que esa persona sea considerada un “paciente calificado” hasta que el Departamento emita los documentos de identificación.

(c)  LIMITACIONES.

(1) Nada en esta sección permite la violación de ninguna otra ley para el cumplimiento de las previsiones de esta sección.

(2) Nada en esta sección debe afectar o revocar las leyes relacionadas con la posesión, la producción, la venta o el uso no medicinal de la marihuana.

(3)  Nada en esta sección autoriza el uso de la marihuana medicinal por parte de otra persona que no sea el paciente calificado.

(4)  Nada en esta sección permite la operación de ningún vehículo, aeronave, tren o bote bajo la influencia de la marihuana.

(5)  Nada en esta sección implica la violación de la ley federal o pretende dar inmunidad ante la misma.

(6)  Nada en esta sección exige el establecimiento de ninguna facilidad para el uso medicinal de la marihuana en una institución correccional, en un centro de detención o lugar de educación o empleo, o fumar marihuana medicinal en un algún lugar público.

(7) Nada en esta sección requiere de un proveedor de seguros médicos o del reembolso de los gastos relacionados con el uso medicinal de la marihuana por parte de cualquier agencia gubernamental o autoridad.

(8)  Nada en esta sección afecta o revoca las leyes relacionadas con la negligencia o mala praxis profesional de un paciente calificado, un cuidador, un médico, un CTMM o sus agentes o empleados.

(d) OBLIGACIONES DEL DEPARTAMENTO.   El Departamento debe dictar las regulaciones necesarias para la implementación y ejecución de esta sección. El propósito de las regulaciones es asegurar la disponibilidad y el uso seguro de la marihuana medicinal por parte de los pacientes calificados. El deber del Departamento es promulgar las regulaciones en el momento oportuno.

(1)   Implementación de las Regulaciones. Con el objetivo de darle al Departamento el tiempo suficiente tras la aprobación de esta sección, las siguientes regulaciones deben ser promulgadas antes de los seis (6) meses de la fecha efectiva de esta sección:

a.  Los procedimientos para la expedición y renovación anual de los documentos de identificación de las personas con certificados médicos y los requisitos para su renovación. Para la emisión del documento de identificación de un menor, el Departamento debe recibir un consentimiento escrito del padre o responsable legal junto con el certificado médico.

b.  Los procedimientos que establecen las calificaciones y estándares para los cuidadores, incluyendo el apropiado control de los antecedentes, y los procedimientos para la emisión y renovación anual de su documento identificatorio.

c.  Los procedimientos para la registración de los CTMM, que incluyen los trámites para la emisión, renovación, suspensión y anulación del registro, y las normas para garantizar la seguridad, el mantenimiento de los registros, las pruebas, el etiquetado, la inspección y la seguridad.

d.  Una regulación que defina la cantidad de marihuana que se considera adecuada para el uso de los pacientes calificados, basada en la mejor evidencia disponible. La presunción en cuanto a la cantidad puede ser modificada si hay evidencia que indique que un paciente calificado puede necesitar una mayor cantidad.

(2)  Documentos de identificación y registros. El Departamento debe comenzar a emitir los documentos de identificación de los pacientes calificados y de los cuidadores, y registrar a los CTMM antes de los nueve (9) meses de la fecha efectiva de esta sección.

(3) Si el Departamento no emite las regulaciones o si el Departamento no emite los documentos de identificación ni registra los CTMM antes del tiempo estipulado en esta sección, cualquier ciudadano de Florida puede solicitar una reparación judicial y obligar al Departamento a cumplir con sus obligaciones constitucionales.

(4) El Departamento debe proteger la confidencialidad de todos los pacientes calificados. Todos los registros que contengan su identidad deben ser confidenciales y no pueden ser divulgados públicamente más que para validaciones médicas o con fines policiales.

(e) LEGISLACIÓN.   Nada en esta sección debe limitar a la legislatura de promulgar leyes consistentes con esta sección.

(f) DISOCIACIÓN.   Las disposiciones de esta sección son disociativas y si alguna cláusula, sentencia, párrafo o sección  de esta medida, o una aplicación de la misma, es considerada inválida por un tribunal de jurisdicción competente, las restantes disposiciones deben continuar vigentes con el máximo alcance posible.

EXENCIÓN DE IMPUESTOS PARA LOS SOCORRISTAS CON UNA DISCAPACIDAD TOTAL

Se propone una enmienda a la Constitución del Estado que autorice a los socorristas con una discapacidad total permanente, como consecuencia de las heridas provocadas durante el cumplimiento del deber, a recibir un reducción de los impuestos ad valorem estimados sobre las propiedades, si es autorizado por ley. Si es aprobado por los votantes, la enmienda entraría en vigencia el 1° de enero de 2017.

ARTÍCULO VII

FINANZAS Y TRIBUTACIÓN

SECCIÓN 6.  EXENCIONES DE PROPIEDAD.—

(a)  Toda persona que posea el titulo legal o de propiedad del inmueble y mantenga la residencia permanente como propietario del mismo, u otra dependencia legal o natural sobre el propietario, estará exento del pago de impuestos, con excepción de aquellas asignaciones por beneficios especiales, hasta la valuación estimada de veinticinco mil dólares y de todas las exacciones excepto las correspondientes a las de escuelas de distrito, sobre una tasación estimada superior a los cincuenta mil dólares y hasta el valor de setenta y cinco mil dólares, en un todo de acuerdo a los derechos establecidos por la ley. El inmueble puede conservarse a través del título legal o de propiedad, en su totalidad, en conjunto, en común, como un condominio, o de manera indirecta por tenencia de acciones o la representación del propietario o del interés del propietario en una corporación que sea propietaria de una comisión o el arrendamiento inicial que haya excedido los noventa y nueve años. La exención no se aplicará a ninguna refinanciación gravada hasta que se determine, por parte de una agencia del estado designada por ley, que  dicha refinanciación cumple con todas las provisiones de la sección 4. Esta exención será revocada en la fecha efectiva de cualquier enmienda de la presente Ley que estipule una tasación de la propiedad habitada a un valor menor que el valor de mercado.

(b) Sólo se permitirá una exención para cualquier unidad individual o familiar o en relación a cualquier unidad residencial. Ninguna exención deberá superar el valor de la tasación de la propiedad al dueño o, en el caso de propietarios a través de acciones o de la pertenencia a una corporación, el valor de la proporción en que el interés de la corporación pueda soportar el valor de tasación de la propiedad.

(c)  Por ley y sujeto a las condiciones especificadas con anterioridad, la Legislatura puede proveerle a los inquilinos que sean residentes permanentes, una reducción del impuesto ad valorem en todas las exacciones del mismo. Tal exención debe respetar el formato y el monto establecidos por la ley.

(d) La Legislatura puede, por ley, permitir a los condados o municipios, con el propósito de sus respectivas exacciones fiscales y sujeto a lo dispuesto en la ley, conceder una o ambas de las siguientes exenciones fiscales adicionales a la propiedad:

(1)  Una exención que no exceda los veinticinco mil dólares a cualquier persona que posea el titulo legal o el título de propiedad del inmueble y mantenga la residencia permanente como propietario, que haya alcanzado los sesenta y cinco años y cuyo ingreso, tal como está definido en la ley, no exceda los veinte dólares; o

(2) Una exención igual al valor de tasación de la propiedad a una persona que tenga el título legal o el título de propiedad del inmueble con un valor de mercado inferior a doscientos cincuenta mil dólares y que haya mantenido la residencia permanente del propietario por no menos de veinticinco años, haya alcanzado los sesenta y cinco años y cuyo ingreso no supere el límite de ingresos establecido en el párrafo (1).La ley debe permitir que los condados y municipios autoricen estas excepciones adicionales, dentro de los límites establecidos en este inciso, por la ordenanza adoptada en la forma prescrita por la ley, y debe proporcionar el ajuste periódico de la limitación de la renta estipulada en el presente inciso para cambios en el costo de vida.

(e)  Todo aquellos veteranos de 65 años o más que tengan una discapacidad parcial, total o permanente deben recibir un descuento del monto del impuesto ad valorem contraído sobre la propiedad del inmueble que el veterano posee y en la que reside, si su discapacidad fue producida en un combate y el veterano fue dado de baja honorablemente al momento de la finalización del servicio militar. El descuento debe ser un porcentaje igual al porcentaje de discapacidad permanente, producto de su actuación en el servicio militar, y debe ser determinado por el Departamento de Asuntos Veteranos de los Estados Unidos. Para calificar para el descuento concedido por este inciso, el candidato debe presentarle a un tasador de la propiedad del condado, para el 1° de marzo, una carta oficial del Departamento de Asuntos Veteranos de los Estados Unidos que constate el porcentaje de la discapacidad del veterano y toda la evidencia que relacione de manera razonable a la discapacidad con el combate, y una copia del descargo honorable del veterano. Si el tasador de la propiedad rechaza el pedido de descuento, debe notificar por escrito al candidato cuáles fueron las razones de su rechazo, y el veterano puede volver a aplicar. La Legislatura puede, por ley, no exigir el requerimiento para las aplicaciones anuales en los años siguientes. Este inciso es de aplicación directa y no requiere de implementación legislativa.

(f)  Por ley y sujeto a las condiciones y limitaciones especificadas, la Legislatura puede proporcionar una exención al impuesto ad valorem que sea igual al monto total o a una porción del impuesto ad valorem contraído sobre la propiedad de la vivienda a la:

(1) La esposa sobreviviente de un veterano que murió por causas relacionadas con el servicio militar durante el cumplimiento del deber como miembro de las Fuerzas Armadas de los Estados Unidos.

(2) La esposa sobreviviente de un socorrista que murió en cumplimiento del deber.

(3)Un socorrista que está total y permanentemente discapacitado como resultado de una lesión o varias sufridas en el cumplimiento del deber. La conexión causal entre la discapacidad y el servicio en el cumplimiento del deber no se debe presumir sino que debe ser determinada conforme a lo dispuesto por la ley. A los efectos de este párrafo, el término “discapacidad “ no incluye una condición crónica o una enfermedad crónica, a menos que la lesión sufrida en el cumplimiento del deber sea la única causa de la condición o enfermedad crónica. Tal como se usa en este inciso y tal como se describe en la ley, el término:

a . “Socorrista” significa un oficial de policía, un funcionario del correccional, un bombero, un técnico de emergencias médicas, o un paramédico, y el término.

b . “En la línea del deber” significa que surgió del cumplimiento real requerido por el empleo como socorrista.

ARTÍCULO XII

PROGRAMA

La exención impositiva para los socorristas con una discapacidad total y permanentemente.—La enmienda a la Sección 6 del Artículo VII en relación a la exención de los impuestos ad valorem basados en la propiedad de la vivienda para los socorristas con una discapacidad total y permanente como consecuencia de las heridas sufridas en el cumplimiento del deber, entra en vigencia el 1° de enero de 2017.

Se propone una enmienda a la Constitución del Estado para revisar la exención del impuesto a la propiedad que pueden conceder los condados o municipios para propiedades cuyo valor de mercado sea menor a $ 250.000 y cuyos dueños sean residentes mayores, de bajos recursos y con antigüedad de residencia, y para especificar que el valor de mercado está determinado en el primer año de impuesto en el que el propietario aplica y que tiene derecho a la exención. La enmienda entra en vigencia el 1° de enero de 2017, y se aplica retroactivamente a las exenciones concedidas antes del 1° de enero de 2017.

ARTÍCULO VII

(d) La Legislatura puede, por ley, permitir a los condados o municipios, con el propósito de sus respectivas exacciones fiscales y sujeto a lo dispuesto en la ley, conceder una o ambas de las siguientes exenciones fiscales adicionales a la propiedad:

(1)  Una exención que no exceda los veinticinco mil dólares a una cualquier persona que tiene el título legal o el título de propiedad del inmueble y mantenga la residencia permanente como propietario, y que haya alcanzado los sesenta y cinco años, y cuyo ingreso, tal como está definido en la ley, no exceda los veinte dólares; o

(2) Una exención igual al valor de tasación de la propiedad a una cualquier persona que tiene el título legal o el título de propiedad del inmueble con un valor de mercado inferior a doscientos cincuenta mil dólares, según lo determinado en el primer año de impuestos en el que el propietario aplica y es beneficiario de la exenció, y que ha mantenido la residencia permanente del propietario por no menos de veinticinco años, y ha alcanzado los sesenta y cinco años, y cuyo ingreso no supere el límite de ingresos establecido en el párrafo (1).

Exenciones adicionales del impuesto ad valorem para las personas de sesenta y cinco años o más. -Esta sección y la enmienda a la Sección 6 del Artículo VII respecto a la determinación del valor de mercado para la exención del impuesto ad valorem para personas de edad de sesenta y cinco años o más, empezará a regir el 1° de enero de 2017, tras la aprobación de los electores, y actuará con carácter retroactivo al 1° de enero de 2013, para cualquier persona que reciba la exención prevista en el párrafo (2) de la Sección 6 (d) del Artículo VII del 1° de enero de 2017.
