TOGETHER WITH (a) any and all awards or payments, including interest thereon and the right to receive the same, growing out of or resulting from any exercise of the power of eminent domain (including the taking of all or any part of the Land), or any altercation of the grade of and street upon which the Land abuts, or any other injury to, taking of, or decrease in the value of the Land or any part thereof; (b) any unearned premiums on any hazard, casualty, liability, or other insurance policy carried for the benefit of Mortgagor, Mortgagee and/or the Land; (c) Mortgagor’s rights in and to all supplies and materials delivered to or located upon the Land and used or usable in connection with the construction or refurbishing of improvements on the Land; and (d) Mortgagor’s rights in, to, under, by virtue of, arising from or growing out of any and all present or future contracts, instruments, accounts, insurance policies, permits, licenses, trade names, plans, appraisals, reports, paid fees, choses-in-action, or other tangibles whatsoever now or hereafter dealing with, affecting or concerning the Land, the improvements thereto, or any portion thereof or interest therein, including but not limited to: (i) all contracts, plans and permits for or related to the Land or its development or the construction or refurbishing of improvements on the Land, (ii) any agreements for the provision of utilities to the Land, including without limitation, all capacities, reservations, tap-in and connection fees and rights, deposits and similar rights relating to sewer, water, and other utilities for the benefit of the Land, (iii) any wetland mitigation credits (iv) all payment, performance and/or other bonds, and (v) any contracts now existing or hereafter made for the sale by Mortgagor of all or any portion of the Land, including any deposits paid by any purchasers (howsoever such deposits may be held) and any proceeds of such sales contracts, including any purchase-money notes and mortgages made by such purchasers, and (vi) any declaration of restrictions, covenants, easements or similar documents now or hereafter recorded against the title to all or any portion of the Land; and

TOGETHER WITH all of Mortgagor’s rights to enter into any lease or lease agreement regarding all or any part of the Land, and all of Mortgagor’s rights to encumber the Land further for debt.

NOTICE OF PUBLIC HEARING

The Walton County Board of County Commissioners will hold a regular meeting on Tuesday, March 8, 2011, at 5:00 p.m. or as soon thereafter as may be heard at the Walton County Courthouse Annex located at 31 Coastal Centre Boulevard, Santa Rosa Beach, Florida.  The following items will be heard:

QUASI-JUDICIAL ITEMS:

1. H & S NURSERY AND SUPPLIES – Project Number 10-001-00033.  This is a major development order application submitted by Emerald Coast Associates, Inc., for storage of landscape and hardscape materials only.  The site totals 1.04 acres, with a future land use of Light Industrial and is located at the NE corner of the U.S. 98 intersection with Bishop-Tolbert Road (parcel number 27-2S-20-33000-010-0000).

2. NOTICE OF PUBLIC HEARING

The Walton County Planning Commission will hold a public meeting on Thursday, March 10, 2011, at the South Walton County Courthouse Annex located at 31 Coastal Centre Boulevard, Santa Rosa Beach, Florida 32459 beginning at 5:00 pm, to hear the following items:

LEGISLATIVE ITEMS:

1. POINT WASHINGTON NEIGHBORHOOD PLAN – An ordinance amending Section 2.03.02 of the Walton County Land Development Code to adopt the Point Washington Neighborhood Plan as an overlay district;  establishing a defined boundary; establishing that the intent of the plan is to preserve the unique heritage of the Point Washington neighborhood and to ensure compatibility for future development; establishing development standards; establishing provisions for permitted uses, maximum density and intensity, setbacks, build-to-lines, lot coverage, allowable accessory structures, tree protection, short-term rentals, signage, parking requirements for new construction, and an off-street parking requirements chart; providing for the incorporation of the Point Washington Neighborhood Plan as Appendix NP-5 to the Walton County Land Development Code; providing for severability; and providing for an effective date.

QUASI-JUDICIAL ITEMS:

2. BAXTER BEACH PUD – Project number 10-001-00019.  This is a major development application submitted by Emerald Coast Associates, requesting an 8 lot planned unit development on 1.23 acres, with a future land use of NPA-infill.  The site is at the northeast corner of the intersection of Lakeshore Drive and Walton Magnolia Lane (parcel number 36-3S-18-16100-000-2380).

The Planning Commission will make a recommendation to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any agenda item that is tabled will be scheduled for a future Planning Commission meeting and will not go forward to the Board of County Commissioners until the Planning Commission makes a recommendation.
