NOTICE OF INTENT OF THE
SCHOOL BOARD
OF WALTON COUNTY, FLORIDA
TO ADOPT A SCHOOL BOARD RULE SETTING FORTH SOCIAL MEDIA POLICIES AND PROCEDURES IN THE WALTON COUNTY SCHOOL DISTRICT

The School Board of Walton County, Florida, hereby gives notice of its intent to adopt the proposed rule setting forth Social Media policies and procedures governing the pedagogical usage of social media outlets in the Walton County School District, pursuant to the procedures set forth in the Administrative Procedures Act.

PURPOSE AND EFFECT:  The purpose and effect of the adoption of the proposed rule is to set forth the rights and responsibilities of approved users as pertains to the usage of social media outlets.

SUMMARY:    Policies and procedures for the appropriate usage of social media outlets in the Walton County School District will provide a framework for evaluating and maintaining a consistent pedagogical purpose within the schools.
LEGAL  AUTHORITY:  The adoption of the proposed rule is authorized by Sections 1001.41, 1001.42, 1001.43, and 1006.09, Florida Statutes..
ECONOMIC IMPACT:  The adoption of the proposed rule will not result in any additional costs to the School District.

A public hearing will be held by the School Board of Walton County, Florida, at 9:00 o’clock a.m. during the regular board meeting on March 13, 2012, in the Board Room at the Tivoli Administrative Complex, 145 Park Street, DeFuniak Springs, Florida, for the purpose of considering adoption of the proposed rule setting forth Social Media policies and procedures for the pedagogical use of social media.   Any person may appear at the hearing and present evidence and argument and be heard concerning the adoption of the proposed rule.  Immediately following the public hearing, the School Board of Walton County, Florida will consider final action to adopt the proposed rule.

The entire text of the proposed rule is on file and available for inspection during regular office hours at the office of the Superintendent of Schools, Walton County, Florida, which office is located at 145 Park Street, Suite 2, DeFuniak Springs, Florida.  Copies of the proposed rule are available to the public at the Superintendent’s office.

If a person decides to appeal any decision made by the School Board with respect to any matter considered at such meeting or hearing, such person will need a record of the proceedings, and for such purpose, such person may need to ensure that a verbatim record of the proceedings is made, which record includes the testimony and evidence upon which the appeal is to be based.

The Design Review Board will make a recommendation on major developments to the Board of County Commissioners regarding these items either to approve, approve with conditions or to deny.  Any item that is tabled will be scheduled for a future Design Review Board meeting and will not go forward to the Planning Commission until the Design Review Board makes a recommendation.  In matters regarding deviations from the Scenic Corridor guidelines, as adopted in Section 13 of the Walton County Land Development Code, the decision by the Design Review Board are final decisions.  Pursuant to Section 9.06.06 of the Walton County Land Development Code, any decision or determination of the Board which is contested by an applicant with regard to application or interpretation of the standards shall be referred to the Board of Adjustment for appeal hearing.

In accordance with Section 286.26, Florida Statutes, whenever any board or commissioner of any state agency or authority, or of any agency or authority of any county, municipal corporation, or other political subdivision, which has scheduled a meeting at which official acts are to be taken receives, at least 48 hours prior to the meeting, a written request by a physically handicapped person to attend the meeting, directed to the chairperson or director of such board, commission, agency, or authority, such chairperson or director shall provide a manner by which such person may attend the meeting at its scheduled site or reschedule the meeting to a site which would be accessible to such person.

Notice is given that stormwater permit number 1249 was issued on January 19, 2012, to Vulcan
Construction Materials, LP for the construction of a surface water management system to provide water quality treatment and stormwater attenuation for a terminal facility for the transport, storage and distribution of aggregate materials, located on the south side of U.S. Hwy 90, DeFuniak Springs.

The file containing the application for this permit is available for inspection Monday through
Friday (except for legal holidays), 8:00 a.m. to 5:00 p.m. at the Northwest Florida Water Management District’s ERP Office, The Delaney Center Building, Suite 2-D 2252 Killearn Center Boulevard, Tallahassee, FL 32309.

A person whose substantial interests are affected by the District permitting decision may petition for an administrative hearing in accordance with Sections 120.569 and 120.57 F.S., or may choose to pursue mediation as an alternative remedy under Section 120.573, Florida Statutes, and Rules 28-106.111 and 28-106.401-404, Florida Administrative Code. Petitions must comply with the requirements of Florida Administrative Code, Chapter 28-106 and be filed with (received by) the District Clerk located at District Headquarters, 81 Water Management Drive, Havana, FL 32333-4712. Petitions for administrative hearing on the above application must be filed within twenty-one (21) days of publication of this notice or within twenty-six (26) days of the District depositing notice of this intent in the mail for those persons to whom the District mails actual notice. Failure to file a petition within this time period shall constitute a waiver of any right(s) such person(s) may have to request an administrative determination (hearing) under Sections 120.569 and 129.57, F.S., concerning the subject permit. Petitions which are not filed in accordance with the above provisions are subject to dismissal.

Because the administrative hearing process is designed to formulate final agency action, the filing of a petition means that the District’s final action may be different from the position taken by it in this notice of intent. Persons whose substantial interests will be affected by any such final decision of the District on the application have the right to petition to become a party to the proceedings, in accordance with the requirements set forth above.
